Only the French version (<a href=\"https:\/\/preprod.xaviers.photo\/en\/terms-of-sale\/\">Conditions g\u00e9n\u00e9rales de vente<\/a>) is legally binding and governs the contractual relationship.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Last updated: 6 August 2026<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Article 1 \u2014 Purpose and scope<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms and Conditions of Sale (hereinafter the \u201cT&amp;Cs\u201d) govern every order placed on the xaviers.photo website by a buyer (hereinafter the \u201cClient\u201d) with Xavier Sch\u00e4llebaum, photographer and artist-author (hereinafter the \u201cSeller\u201d or the \u201cArtist\u201d).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The T&amp;Cs apply without restriction or reservation to every order of limited-edition art prints. The Client acknowledges having read and accepted the T&amp;Cs before validating their order, by ticking the box provided for that purpose.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Article 2 \u2014 Characteristics of the works<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The photographs offered on the xaviers.photo website are limited-edition art prints, conforming to the status of original work of art as defined in article 98 A of annex III of the French General Tax Code. Each edition is strictly limited to&nbsp;<strong>thirty (30) exemplars at most, all formats and media combined, artist\u2019s proofs included<\/strong>. The first three numbers of each edition (1, 2 and 3) are reserved for artist\u2019s proofs; prints offered for public sale therefore begin at number 4. Beyond thirty exemplars, no further print may ever be made, in any format or on any medium.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each print is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Numbered by hand by the Artist<\/li>\n\n\n\n<li>Signed by hand by the Artist<\/li>\n\n\n\n<li>Accompanied by an original certificate of authenticity, numbered, dated, signed and sealed<\/li>\n\n\n\n<li>Fitted with a numbered back authentication label signed by the Artist, affixed to the back of the work (or its support)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The technical characteristics (printing technique, paper, format, finish) are specified on each work\u2019s detailed page.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The photographs presented on the site are reproduced with the greatest care, but minor chromatic variations are possible between on-screen display and the final print, owing to differences in calibration, lighting and medium. Such variations cannot engage the Seller\u2019s liability.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Article 3 \u2014 Prices<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Prices are stated in euros inclusive of all taxes, including VAT at the reduced rate of 5.5% applicable to original works of art (article 278-0 bis of the French General Tax Code). This preferential taxation applies as of right once the conditions of the original work are met (edition limited to 30 exemplars in total, artist\u2019s proofs included, numbering, artist\u2019s signature).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prices do not include shipping costs, which are stated separately before the order is validated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The price of each print is <strong>calculated according to the chosen dimensions (to the centimetre), the printing technique and the framing option<\/strong> selected by the Client. The dimensions respect in all circumstances the proportions (the aspect ratio) specific to each work: the length is free <strong>from 60 cm upwards<\/strong> and up to a <strong>maximum dimension which depends on the printing technique and framing chosen<\/strong>. These minimum and maximum dimensions are specified on each work\u2019s page and on the \u201cPrints &amp; Editions\u201d page.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The price displayed on the work\u2019s page updates in real time according to these choices. It includes the print, its mounting and finish, the <strong>hanging system when the print is delivered unframed<\/strong> (recessed frame or wooden rail depending on dimensions, included at no extra charge) and, where applicable, the chosen framing. It does not include shipping costs.<\/p>\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n<!-- \/wp:post-content --><p>This number-based increase applies to the <strong>artistic part of the print<\/strong> (printing, mounting and finish); it does not apply to the framing supplement.<\/p><!-- wp:paragraph \/--><ul class=\"wp-block-list\"><li>Prints 4 to 10: base price (Tier I)<\/li><li>Prints 11 to 20: base price plus 25% (Tier II)<\/li><li>Prints 21 to 30: base price plus 50% (Tier III)<\/li><\/ul><!-- wp:list \/--><p>The price of a print offered for public sale also progresses according to the number available in the edition:<\/p><!-- wp:paragraph --><!-- wp:paragraph -->\n<p>The <strong>artist\u2019s proofs (numbers 1 to 3)<\/strong> are not offered for open sale on the site: they are the object of an <strong>acquisition at the Artist\u2019s invitation, at a price agreed privately<\/strong> between the Artist and the acquirer. The acquirer then receives a personal private link allowing them to finalise their acquisition online, under the same terms and with the same documents as any other print.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>The price displayed on the page at the time of ordering is the one that applies.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>The Artist reserves the right to change his prices at any time, it being understood that works will be invoiced on the basis of the rates in force at the time the order is registered.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\">Article 4 \u2014 Order, reservation and confirmation<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Orders are placed exclusively online on the xaviers.photo website. The Client selects the work, the printing technique, the framing and the desired dimensions, adds the product to the cart, and proceeds to payment after accepting these T&amp;Cs.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>When a print is added to the cart, the corresponding print number is reserved for sixty (60) minutes.<\/strong>&nbsp;During this period, that number is no longer offered to other buyers. If payment is not completed within this 60-minute period, the reservation is automatically cancelled and the print number becomes available for sale again to other Clients.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>The order becomes firm and final upon receipt of full payment.&nbsp;<strong>As soon as payment is validated, the Client receives a confirmation email and has access, in their collector\u2019s space (\u201cMy orders\u201d section), once their account has been activated, to an order form, an invoice and a provisional certificate of authenticity.<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>The Artist reserves the right to refuse any order on any legitimate ground, in particular exhaustion of the edition, a pricing error, or suspicion of fraud. In such a case, the Client is refunded immediately.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\">Article 5 \u2014 Payment<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Payment is made online by bank card (Visa, Mastercard, American Express), Apple Pay, Google Pay, Bancontact or iDEAL via the secure Stripe platform, certified PCI-DSS level 1, or by SEPA bank transfer. Where payment is made by bank transfer, the order is confirmed upon receipt of the transfer. No banking data is retained by the Seller.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Instalment or deferred payment may be offered via Klarna, subject to eligibility as determined by that provider (amount, country, buyer profile), under the conditions displayed at the time of payment. The Seller is paid the full price at the time of the order; the payment facility constitutes a separate contract between the Client and Klarna.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\">Article 6 \u2014 Production and lead times<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Each print is made to order at the Artist\u2019s reference atelier in Paris (atelier PICTO). Usual lead times are:<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list -->\n<ul class=\"wp-block-list\"><!-- wp:list-item -->\n<li>Production of the print: 7 to 10 working days<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>Plexiglass mounting (if applicable): 5 additional working days<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>Framing (if applicable): 5 additional working days<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>Preparation and dispatch: 2 working days<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>Transit: metropolitan France 2\u20134 working days; EU 4\u20137 days; international 7\u201315 days (excluding customs delays)<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>The Seller will endeavour to meet these lead times. Any significant overrun will be notified to the Client by email.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\">Article 7 \u2014 Delivery<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Delivery is carried out by a carrier selected case by case, according to the dimensions of the work, its weight and the delivery destination, with a constant requirement for the highest standard of service and insurance included up to the invoiced value.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Shipping costs are calculated according to destination and apply <strong>per print ordered<\/strong>&nbsp;: when an order includes several prints, the corresponding costs are cumulative, each work being packed and protected individually. The scale, per print, is as follows:<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list -->\n<ul class=\"wp-block-list\"><!-- wp:list-item -->\n<li>Metropolitan France: \u20ac60 incl. VAT<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>French overseas territories: \u20ac150 incl. VAT<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>European Union: \u20ac120 incl. VAT<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>International (outside the European Union): \u20ac250 incl. VAT, excluding customs duties and local taxes payable by the Client<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>Other countries: on quotation \u2014 please contact us at contact@xaviers.photo before ordering<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>For deliveries to the United States: works of art and photographs currently benefit from exemptions from US customs duties; as US customs regulations are subject to change, any duties, import taxes and local taxes (sales tax\/use tax) remain, as for any destination outside the European Union, the sole responsibility of the Client.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>The exact shipping cost is calculated and displayed <strong>before payment is confirmed<\/strong>, according to the destination and the number of prints ordered.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Upon receipt, the Client must check the condition of the packaging and of the work in the carrier\u2019s presence. In the event of apparent damage, they must refuse delivery or record precise, detailed reservations on the transport note. Failing this, the Artist cannot be held liable for any damage observed subsequently.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\">Article 8 \u2014 Works made to order and right of withdrawal<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>XAVIER S. art prints are works made to order: each exemplar is printed, numbered and signed specifically for the Client, according to the choices they express when ordering (dimensions, printing technique, finish and, where applicable, framing). No exemplar is held in stock prior to the order.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Consequently, in accordance with article L.221-28, 3\u00b0 of the French Consumer Code, which excludes the right of withdrawal for goods made to the consumer\u2019s specifications or clearly personalised, the sale of a XAVIER S. art print&nbsp;<strong>does not carry a right of withdrawal<\/strong>.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>The Client is informed of this exclusion clearly and in advance, before validating their order, and expressly accepts it by ticking the box provided for that purpose at the time of payment. This information is restated on the order form and on the delivery note provided to them.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>The signing of the work\u2019s delivery note, carried out electronically from the \u201cMy orders\u201d area on xaviers.photo, attests that the work has been delivered conforming and in perfect apparent condition, and makes the sale final. It triggers the&nbsp;<strong>conversion of the provisional certificate of authenticity into the final certificate of authenticity<\/strong>, available in digital form (bearing a verification QR code, accessible from the \u201cMy orders\u201d area) and in a paper version delivered with the work. The work is also accompanied by its numbered back authentication label signed by the Artist.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>This exclusion of the right of withdrawal deprives the Client of no legal guarantee: the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code) remain fully applicable (see Article 9). In the event of a work damaged in transit or not conforming to the order, the Artist bears the cost of return as well as replacement or refund, at no cost to the Client.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\">Article 9 \u2014 Guarantees<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>The Artist is bound by the legal guarantees of conformity (articles L.217-3 et seq. of the French Consumer Code) and against hidden defects (articles 1641 et seq. of the French Civil Code). These guarantees entitle the Client to a replacement, a refund or a price reduction in the event of a defect affecting the work.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Any claim must be sent by email to contact@xaviers.photo, accompanied by photographs of the defect and the certificate of authenticity, within a reasonable time of its discovery.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\">Article 10 \u2014 Intellectual property and use<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>The purchase of a print conveys ownership of the material object (the print and its certificate) but conveys no assignment of copyright in the photographic work. In particular, the Client is not authorised to:<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list -->\n<ul class=\"wp-block-list\"><!-- wp:list-item -->\n<li>Reproduce the work in any form whatsoever<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>Publicly disseminate the work (press, commercial exhibitions, social media for a third party\u2019s promotional purposes)<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>Modify or distort the work<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>Make new prints<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>The purchased work may be displayed in a private setting, lent free of charge or resold on the secondary market. Resale conveys no right of reprinting.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\">Article 11 \u2014 Transfer of ownership<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Transfer of ownership of the work is subject to full payment of the price. Transfer of risk (loss, theft, damage) occurs upon actual delivery to the Client.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\">Article 12 \u2014 Secondary market and resale right<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>In accordance with article L.122-8 of the French Intellectual Property Code, the Artist benefits from a resale right on any resale of the work by an art-market professional (gallery, auction house), at 4% of the resale price excluding VAT above \u20ac750 (degressive rate above \u20ac50,000). This right does not apply to sales between private individuals.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\">Article 13 \u2014 Liability<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>The Artist cannot be held liable for any indirect damage (operating loss, commercial prejudice, etc.) or for any event of force majeure as defined by French case law.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:heading -->\n<h2 class=\"wp-block-heading\">Article 14 \u2014 Personal data<\/h2>\n<!-- \/wp:heading -->\n\n<!-- wp:paragraph -->\n<p>Personal data collected in connection with orders are processed in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.
